Minutes of Planning Meeting held at the BYPA Hall on 14 December 2009

PRESENT: Cllr Tony Prior (Chair), Cllr Michael Edmonds, Cllr Alison Tomkins and 2 members of the public.

 

1. APOLOGIES – Cllr Tamsin Witt, County Cllr Chris Humphries

 

2. DECLARATIONS OF INTEREST - There were no declarations of interest.

 

3. MINUTES OF THE PREVIOUS PARISH COUNCIL MEETING

The minutes of the ordinary meeting on 30 November 09 were approved.

 

4. SUSPENSION OF THE MEETING FOR PUBLIC QUESTION TIME

The meeting was suspended so members of the public could speak to the Parish Council. The members of the public present, together with the Parish Council reviewed the definitive map of Baydon routes surrounding Baydon House.

 

5. PLANNING

 

5.1        Baydon House – Proposed diversion of Baydon 11 and extinguishment of Baydon 1 bridleways.

 

BAYD1/BAYD30

 

The Chairman read a previous letter, dated 13/08/2007 from Sally Madgwick, Wiltshire Council Rights of Way Officer, to Andrew Guest, Planning Department, regarding the proposed diversion of Baydon11 and extinguishment of BAYD1, which states that:

 

‘’ As it seems sensible to deal with  BAYD1 before BAYD 11 I shall seek to establish who the landowners are and to seek their agreement to this approach. Express Dedication requires the production of a plan and an agreement which once signed by the landowner and Highway Authority can be sealed and the Way added to the Definitive Map. Extinguishment of the old BAYD1 route could then be processed under HA1980 s116 or s118”.

 

In an email received from Sally Madgwick, dated 11 December 2009, proof of ownership was received on 12 August 2009, following which BAYD30 was dedicated as a bridleway and  BAYD1 extinguished. In an email dated 14 December 2009 it states that “There is no scope within dedication agreements of this nature for members of the public or neighbours perhaps to object”.

 

BAYD11

 

The Chairman noted the fact that the planning application (K56971F) included alterations to an existing wall and gateway as well as requiring the associated diversion of BAYD 11. This was the reason why it went through the planning route. The appeal against rejection of K56971/F in total  had  been dismissed by a Planning Inspector. The current application (no number on correspondence received) was being dealt with purely as a Rights of Way issue.

The Chairman also noted the apparent lack of interest as demonstrated by the small attendance at the meeting.

 

The Parish Council agreed to Sally Madgwick’s recommendation to re-consult with all parties in the New Year.

5.2        E/09/1576/FUL - Vehicle access at Finches Farm, Finches Lane.

 

This is a retrospective planning application.  However, after a brief discussion regarding vehicular access to a back lane, there were no objections to the planning application.
